1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the PeptideMaxxers website ("Platform") operated by PeptideMaxxers LLC ("we," "us," or "our"), a Texas limited liability company. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any of these Terms, you may not use the Platform.

2. Description of services

The Platform is intended to facilitate the following services: (a) educational content about prescription medications, peptide therapy, and men's health optimization; (b) technology and coordination services connecting you with independent licensed healthcare providers for telehealth consultations; (c) administrative support for scheduling, payment, and coordination of prescription medication fulfillment through licensed compounding pharmacies; and (d) email communications regarding product availability and health-related content.

PeptideMaxxers is a technology and coordination platform. We are not a healthcare provider, pharmacy, or medical practice. All medical consultations, prescriptions, and clinical decisions are made by independent licensed healthcare providers through our affiliated telehealth partners.

3. Eligibility

To use the Platform, you must: (a) be at least 18 years of age; (b) reside in the United States in a state or territory where our services are available; (c) have access to compatible computing or mobile devices and internet connectivity; and (d) agree to be legally bound by these Terms. Meeting these requirements does not guarantee you will receive healthcare services through the Platform. Licensed healthcare providers make all clinical eligibility determinations on a case-by-case basis.

4. Not medical advice

The content on this Platform, including educational articles, compound profiles, and general health information, is provided for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this Platform. If you have a medical emergency, call 911 or your local emergency number immediately.

5. Healthcare services

Healthcare services available through the Platform ("Healthcare Services") are provided by independent licensed healthcare providers affiliated with our telehealth platform partners. These providers exercise independent medical judgment in all clinical decisions, including whether to prescribe medication. PeptideMaxxers does not practice medicine, does not interfere with the provider-patient relationship, and does not guarantee that any particular medication will be prescribed.

You understand and agree that: (a) the assessment on this Platform does not create a doctor-patient relationship between you and PeptideMaxxers; (b) a doctor-patient relationship is formed only between you and the licensed provider who evaluates your medical information; (c) prescribing decisions are made solely by licensed providers based on clinical evaluation; and (d) compounded medications are not FDA-approved products.

6. Compounded medications

Certain medications available through the Platform are compounded by state-licensed, FDA-registered compounding pharmacies. Compounded medications are prepared based on a prescription from a licensed provider for an individual patient. Compounded drug products are not FDA-approved. The FDA does not verify the safety, effectiveness, or quality of compounded drug products. Compounding pharmacies that prepare these medications are registered with and regulated by the FDA and state boards of pharmacy.

7. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts at our discretion.

8. Payment and subscriptions

Certain services available through the Platform require payment. All subscriptions are month-to-month with no long-term contracts or commitments. Your subscription renews automatically every 28 days. You may cancel your subscription at any time through your account portal or by contacting us. Once a prescription has been issued and medication dispensed, refunds cannot be provided for that billing period. Pricing is subject to change with reasonable notice.

9. Intellectual property

All content on the Platform, including text, graphics, logos, images, and software, is the property of PeptideMaxxers LLC or its licensors and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

10. Prohibited conduct

You agree not to: (a) use the Platform for any unlawful purpose; (b) provide false or misleading health information; (c) attempt to obtain prescriptions for anyone other than yourself; (d) reverse engineer, decompile, or disassemble any part of the Platform; (e) interfere with or disrupt the Platform or its servers; (f) use automated systems to access the Platform without our consent; or (g) impersonate any person or entity.

11. Limitation of liability

To the fullest extent permitted by law, PeptideMaxxers LLC, its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform or any Healthcare Services obtained through the Platform. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Disclaimer of warranties

The Platform and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Indemnification

You agree to indemnify, defend, and hold harmless PeptideMaxxers LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute resolution

Any disputes arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration administered in Travis County, Texas, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action. The arbitrator's decision shall be final and binding.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

16. Changes to terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
